Terms of Service
These Terms govern your use of the Notix website at usenotix.dev and the Notix application. Notix is the operator of both and the party you contract with. By using either, you agree to these Terms.
Who you are contracting with
Notix operates and is responsible for this site and the Notix application. Notix is an independent product, operated on its own behalf.
Eligibility and accounts
You may use the site and product only if you can form a binding contract with Notix and are not barred from doing so under applicable law. You are responsible for the security of your account credentials, for your API keys, and for all activity under your account.
Acceptable use
You agree not to misuse the site or product. You may not:
- Violate any applicable law or regulation.
- Infringe the rights of others or violate their privacy.
- Interfere with or disrupt the service or its infrastructure.
- Transmit malicious code, unsolicited bulk mail, or prohibited content.
Anti-spam enforcement
Sending unsolicited marketing email through Notix damages the deliverability of every other customer on the platform, so it is enforced strictly. Marketing sends must use double opt-in verification. Accounts that bypass double opt-in, or that use the transactional API for promotional campaigns, may be suspended or terminated without notice.
Your content and your recipients
You own the email content, templates and contact data you bring to Notix. You are responsible for having a lawful basis to email every recipient you upload, and for honouring unsubscribes. Notix processes that data on your behalf as described in the Privacy Policy.
Fees
Paid plans are billed monthly in advance, and metered usage beyond the included allowance is billed in arrears on the same invoice. Published prices exclude taxes unless stated otherwise. You can cancel at any time; cancellation takes effect at the end of the current billing period.
Intellectual property
The Notix name, logo and marks belong to HitchAfrica Technologies Limited. You may not use them without prior written permission. These Terms cover the hosted service and grant no rights in the software behind it.
Third-party services
Notix relies on infrastructure providers to deliver mail and links to services we do not control. We are not responsible for the content or practices of third-party sites.
Disclaimer
The site and product are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied. Notix does not currently offer a service level agreement.
Limitation of liability
To the fullest extent permitted by law, Notix is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits or revenue.
Indemnification
You agree to indemnify and hold Notix harmless from claims, damages, liabilities and expenses arising out of your use of the site or product, the mail you send through it, or your breach of these Terms.
Changes and availability
We may modify these Terms and change the site or product at any time. Changes take effect when posted. We may suspend or discontinue the service in whole or in part.
Governing law
These Terms are governed by applicable law without regard to conflict-of-law principles. Where required, disputes are subject to the courts of your place of residence or as otherwise mandated by law.
